General Terms and Conditions
1. General
Our homepage provides an up-to-date overview and information about products that can be ordered via our online shop. Products ordered online can either be picked up by the customer or shipped to the customer for a fee. Since the shipping of medicinal products is currently not permitted in Austria, medicinal products ordered via our online shop must in any case be picked up by the customer.
The following General Terms and Conditions (GTC) apply to the sale of goods ordered by customers as consumers (customers) in the online shop of Heiligen Geist Apotheke.
Our offers and deliveries are made exclusively on the basis of these GTC and our conditions for shipping and delivery costs, which form an integral part of these GTC, and can be accessed daily on our homepage under "Our GTC" and "Shipping and Delivery Costs". Our GTC (including shipping and delivery costs) are deemed accepted by the customer placing an order for goods in the current version on the day of the order.
Heiligen Geist Apotheke is entitled to unilaterally change or supplement these GTC, including all components and annexes thereto (in particular shipping and delivery costs), at any time. Orders will be processed according to the GTC (and shipping and delivery costs) that were in force at the time of the order. Deviating agreements between us and the customer require an explicit written agreement.
2. Conclusion of Contract
The online shop merely represents a non-binding overview and information about our products and invites the customer to make an offer. The contract between the customer and Heiligen Geist Apotheke is concluded only through the customer's offer (= the order placed via the online order form) and its acceptance by Heiligen Geist Apotheke. The customer's offer (the order) becomes effective upon its actual receipt by us. It can only be revoked in writing as long as we have not yet gained actual knowledge of the offer. Such a possible revocation is only possible by means of an email immediately following the offer. The customer will be informed about the receipt of the order by an electronic order notification, which provides the customer with an order overview. However, this order notification does not yet constitute an acceptance of the offer.
If goods are ordered for self-pickup, Heiligen Geist Apotheke accepts the customer's offer by sending a confirmation via email, in which the customer is also informed that the goods are ready for pickup.
If the goods are ordered for shipment to the customer, Heiligen Geist Apotheke explicitly accepts the customer's offer by sending a confirmation via email to the customer, informing them of the shipment of the goods, or by telephone notification to the customer, or implicitly by delivering the ordered goods.
If we are unable to fulfill an order or an offer within a reasonable time, or unable to accept an offer, we will inform the customer immediately.

3. Prices / Shipping Costs
The prices indicated are inclusive of the statutory value-added tax, but exclusive of shipping costs, unless expressly stated otherwise. The customer bears the shipping costs and any import duties (customs fees). The customer receives information about shipping costs and postage during the ordering process for each individual order via the online shop. In addition, the customer will find a list of all shipping costs under the "Shipping and Delivery Costs" section.
4. Payment Methods

Bank charges are borne by the customer.
5. Delivery Conditions
Delivery (shipment) for payment by credit card: after positive payment confirmation by the credit card company at the earliest possible date, but no later than within a period of 30 (thirty) days after receipt of this payment confirmation, unless otherwise agreed with the customer.
6. Transfer of Risk
When shipping, the customer expressly approves the customary shipping methods for the ordered goods, such as mail, rail, air, ship, private courier and delivery services like DHL, etc.
The risk of price passes to the buyer upon dispatch of the goods (i.e., handover to the delivery / transport facility) by Heiligen Geist Apotheke.
7. Retention of Title
Heiligen Geist Apotheke retains ownership of the goods until the customer has fully paid the purchase price for the goods, including any shipping and postage costs.
8. Right of Withdrawal
When goods are shipped, the customer, as a consumer, has the right to withdraw from the contract within a period of 14 working days, whereby Saturdays are not counted as working days. The period begins on the day the goods are received by the customer. It is sufficient if the declaration of withdrawal is sent to us in writing within the withdrawal period. However, this right of withdrawal only applies if the delivered goods have not been opened, are in their original condition, if neither soiling nor damage to the goods has occurred through the customer, and the goods have been stored properly.
For goods that have been custom-made according to customer specifications or that are tailored to the personal needs of the customer, the customer has no right of withdrawal.
The costs for the return shipment are to be borne by the customer alone and in full.
Shipping method: The customer must use customary shipping methods and bears the risk of price until the goods are received at the pharmacy.
9. Warranty
The warranty is subject to legal provisions. In the event of a justified complaint, the customer first has the right to rectification, and if necessary, the right to exchange the goods.
The customer is obliged to send the complained goods immediately to Heiligen Geist Apotheke at their own expense. In the event of a justified complaint, these shipping costs will be reimbursed to the customer.
In any case, in the event of a complaint, the customer must prove the purchase date with the invoice belonging to the complained goods, which they must enclose as a copy with the complained goods.
10. Liability
Heiligen Geist Apotheke is liable for material damage and financial losses only in cases of intent and gross negligence.
11. Data Protection
Personal data of the customer will only be collected within the framework of legal data protection regulations and will be used exclusively for the processing of business with the customer. The data transmitted to us by the customer will be stored electronically for these purposes but will not be passed on to third parties.

Should one or more provisions of these GTC be ineffective, both the contract as a whole and the other effective provisions of these GTC shall remain valid.
The place of performance for the concluded contract is Baden.
The materially competent court for Wiener Neustadt is agreed as the place of jurisdiction for all disputes arising from this contract.
The entire contractual relationship is subject to Austrian law.
